I really just posted it because I checked my drafts and realized it was still there.\r\n\r\n\r\n\r\n---\r\n\r\n\r\n\r\n\r\n\r\nThis is the fourth piece of legislation in the \"Zeedith's constitutional cleanup\" lineup of amendments. This series is designed to be made of relatively simple, obviously correct, and useful changes to the constitution along with clarifications and expansions upon existing ideas and precedent. It is decidedly *not* meant to fully fix to the constitution nor be a stand-in for proper reform. If you have ideas for future Z#CCA's feel free to comment them down below. \r\n\r\n\r\n\r\nThis edition in particular contains: Definitions of some of the different types of \"amendments\" along with clauses to avoid confusion with ad hoc amendments to legislation, it also contains protections of the obvious \"only amendments can mess with elections\" and has some obvious things on neutrality in judicial and moderation decisions.\r\n\r\n\r\n\r\n---\r\n\r\n\r\n\r\nSection 1: Definitions\r\n\r\n\r\n\r\nArticle 1: \"Amendment\" is defined as a change to any text, legislation, the constitution, or other media.\r\n\r\n\r\n\r\nArticle 2: A \"Constitutional amendment\" is an amendment that modifies or changes the constitution or constitutional law.\r\n\r\n\r\n\r\nArticle 3: A \"Stipulative legislative amendment\" is defined as the act of council voting on a proposition with something like \"Aye, if it no longer has (thing)\".\r\n\r\n\r\n\r\nArticle 4: A \"Formal legislative amendment\" is defined as a piece of legislation that in-of-itself modifies another piece of legislation—seeing that piece of legislation is not the constitution nor a constitutional amendment—using a structured, logical piece of text that outlines exactly what changes are to be made in what way.\r\n\r\n\r\n\r\n\r\n\r\nSection 2: Regarding amendments\r\n\r\n\r\n\r\nArticle 1: The only legislation that can restrict, modify, shift, or otherwise alter in any way the citizenry's or a citizen's voting rights or the system of voting itself in any way is a constitutional amendment.\r\n\r\n\r\n\r\nArticle 2: If a Stipulative legislative amendment takes place the press minister, council speaker, other council member, or some other member of the Council Voting GC must post, publish, or otherwise make public a copy of the legislation in its amended form to avoid confusion.\r\n\r\n\r\n\r\nArticle 3: The following is how stipulative legislative amendments shall be counted:\r\n\r\n\r\n\r\n* (i) All abstains on the legislation shall take place normally.\r\n\r\n* (ii) All unconditional ayes shall count towards a stipulative legislative amendment.\r\n\r\n* (iii) All unconditional nays shall count against the stipulative legislative amendment.\r\n\r\n* (iv) Any other stipulative legislative amendments that conflict with the stipulative legislative amendment in question shall count against the stipulative legislative amendment.\r\n\r\n* (v) If there is a winning number of ayes excluding stipulative votes the full piece of legislation shall pass.\r\n\r\n* (vi) If multiple stipulative legislative amendments are proposed that conflict, the legislation doesn’t pass on unconditional ayes, and both stipulative legislative amendments have enough votes in favor the one with more stipulative (conditional) votes in favor shall win.\r\n\r\n* (vii) If after (vi) it is still undecided the vice president shall take a tie breaker vote.\r\n\r\n\r\n\r\nArticle 4: Unless explicitly stated a proposition with \"Amendment\" in it's name shall be a constitutional amendment.\r\n\r\n\r\n\r\n\r\n\r\n\r\n\r\nSection 3: Neutrality\r\n\r\n\r\n\r\nArticle 1: Judicial neutrality \r\n\r\n\r\n\r\n* (a) No argument shall be made in a court of law or other body deciding a punishment or guiltiness of a defendant that a defendant or plaintiff's political, economical, or social position should affect their punishment and/or if they're guilty or not, nor shall race, sex, religious standing, or political values unless directly relevant to the case.\r\n\r\n* (b) An exception to (a) is for determining the punishment of fines based off the wealth or economical status of an individual.\r\n\r\n\r\n\r\nArticle 2: No member of the mod-team shall purposefully use a citizen's political or social position when deciding upon a moderation action.\r\n\r\n\r\n\r\n\r\n\r\nSection 4: The branches of governance\r\n\r\n\r\n\r\nArticle 1: The legislative branch shall be defined as the category of government containing council.\r\n\r\n\r\n\r\nArticle 2: The judicial branch shall be defined as the category of government containing the courts and constitutional courts.\r\n\r\n\r\n\r\nArticle 3: The executive branch shall be defined as the category of government containing the president, vice president, ministers, and ministries.\r\n\r\n\r\n\r\nArticle 4: The Administrative branch shall be defined as the category of governance which contains the r/TeenGovernment mod-team and the auxiliary quasi-administrative bodies pertaining to the moderation teams of Official TeenGovernment servers.\r\n\r\n\r\n\r\nSection 5: Fixing the president's power during emergency states to it's intended meaning\r\n\r\n\r\n\r\nArticle 1: Section IV, Article VII \"The president also gains the authority to pass or overrule legislation during emergency states, but cannot change their own powers in the constitution, or the rules of the server.\" shall be modified to read: \"The president also temporarily gains the authority to pass, overrule, and modify legislation expressly excluding the constitution and constitutional amendments, legislation that modifies their own powers, or SMP rules.\".\r\n\r\n\r\n\r\n\r\n\r\nSection 6: Weight of evidence\r\n\r\n\r\n\r\nArticle 1: Members of the Administrative branch must have evidence that it is more likely than not a crime was committed to take a moderation action such as a ban unless:\r\n\r\n\r\n\r\n* (a) It is evident not taking the action immediately could cause immediate foreseeable harm.\r\n\r\n* (b) An internal vote is held within that body of the administrative branch where a majority of members agree that the ban should go forward without further evidence based on reasonable belief the crime took place and/or not taking action could lead to further crimes.\r\n\r\n\r\n\r\n\r\n\r\nSection 7: Enactment\r\n\r\n\r\n\r\nArticle 1: This amendment shall immediately amend the constitution upon passing.\r\n\r\n\r\n\r\nArticle 2: This amendment shall be known as \"Zeedith's fourth Constitutional Cleanup Amendment\" or \"Z4CCA\".\r\n\r\n\r\n\r\n---\r\n\r\n\r\n\r\nclarified
